Choosing an advisory partner means understanding who is advising you, the scope of their service and the protections available to your business. This page explains Harrington Raine’s professional and regulatory position.

About Harrington Raine

Harrington Raine Ltd is a regulatory consultancy specialising in HR, employment law and health and safety for employers.

We provide practical advice, bespoke documentation and ongoing support to help businesses make informed decisions and meet their responsibilities. Our services are delivered under a written agreement setting out the scope of our work, fees and applicable terms.

Our regulatory status

Harrington Raine Ltd is not a firm of solicitors and is not authorised or regulated by the Solicitors Regulation Authority (SRA), the regulator of solicitors and law firms in England and Wales.

The term “regulatory consultancy” describes the work we do: helping businesses understand and manage their legal and regulatory obligations. It does not mean that Harrington Raine is a regulator or an SRA-regulated business.

Where an SRA-regulated solicitor provides services through Harrington Raine, their professional obligations apply to them individually. Their regulatory status does not extend to Harrington Raine Ltd, our wider services or other members of our team.

Our advisors and professional standards

We allocate work according to the expertise and experience required. Your advisor’s role and professional qualifications will be described accurately, and you can ask us for further details at any time.

Any practising solicitor providing services through Harrington Raine must hold an appropriate practising certificate and comply with the professional rules that apply to them, including the SRA Principles and Code of Conduct. These include duties relating to integrity, independence, competence, confidentiality and acting in clients’ best interests.

The scope of our legal services

Our employment law services cover advice, drafting and support that can lawfully be provided through a consultancy. This includes employment contracts, workplace policies, employee relations matters, organisational change and Employment Tribunal defence within the scope of the relevant agreement.

Certain legal services, known as reserved legal activities, require specific authorisation or a legal exemption. Harrington Raine does not undertake work requiring authorisation that it does not hold.

If a matter requires services outside our remit, we will explain this and discuss the arrangements needed for an appropriately authorised provider to assist.

Employment Tribunal defence

Where included in your agreement, Harrington Raine provides Employment Tribunal defence, subject to the applicable service terms.

For a covered claim, this may include preparing and submitting the employer’s response, becoming the named Tribunal representative and managing the stages of the defence included within the service.

Hearing advocacy is not included within the fixed-fee Total Employment Law Cover package. Where required, it can be arranged and quoted separately. We will explain the proposed arrangements and charges before you commit to them.

Support with internal disciplinary, grievance, capability or appeal hearings is a separate HR consultancy service and is distinct from advocacy at an Employment Tribunal hearing.

Health and safety consultancy

Our health and safety services help employers identify risks, implement appropriate measures and manage their legal responsibilities.

The scope of our involvement, including any appointment to provide competent assistance, is set out in your agreement. Appointing Harrington Raine does not transfer an employer’s statutory responsibilities to us. Employers remain responsible for implementing appropriate measures and managing health and safety within their business.

Professional indemnity insurance

Harrington Raine Ltd maintains professional indemnity insurance covering the professional services specified in its policy. Details of the insurer, territorial coverage and applicable limits are available on request.

As Harrington Raine is not an SRA-authorised firm, it is not required to maintain insurance on the SRA’s Minimum Terms and Conditions. Our insurance arrangements should therefore not be assumed to provide the same protection as those of an SRA-regulated law firm.

Professional indemnity insurance is separate from any legal expenses insurance that a client may purchase.

Client money and compensation arrangements

Harrington Raine does not operate a client account or hold money on behalf of clients, including settlement monies or Tribunal awards. Payments for our own fees are made in accordance with your service agreement.

The SRA Compensation Fund is not available in respect of services provided through Harrington Raine’s consultancy model. This remains the position where an SRA-regulated solicitor provides those services through the company.

Confidentiality and personal information

We treat information about your business and its people as confidential. Information is shared only where necessary to deliver the agreed services, with your authority, or where disclosure is otherwise legally permitted or required.

We handle personal information in accordance with applicable data protection law. Our Privacy Notice explains how we collect, use, retain and protect personal information, together with the rights available to individuals.

Fees and service terms

Before you instruct us, we explain the services to be provided, the applicable fees and any relevant exclusions.

Your written agreement sets out the contractual terms, including payment arrangements, the duration of the service and provisions relating to renewal and termination. Any additional work or separately chargeable services will be agreed with you before we proceed.

Raising a concern or making a complaint

If you are unhappy with any aspect of our service, please tell us so that we can investigate and respond.

Legal Ombudsman

Where your complaint concerns legal services provided by an SRA-regulated solicitor through Harrington Raine, you may be eligible to refer it to the Legal Ombudsman.

Eligibility depends on the nature of the complaint and the Ombudsman’s Scheme Rules, including the rules governing which individuals and organisations can complain. This route does not automatically apply to every client or to all Harrington Raine services.

Where you are eligible, you can normally refer a complaint after receiving our final response, or if it remains unresolved eight weeks after you first complained to us. Time limits apply.

Concerns about a solicitor’s conduct

Concerns about the professional conduct of an SRA-regulated solicitor can be reported to the SRA. This is separate from our complaints process and the Legal Ombudsman’s role in considering service complaints.
